He also has not been paying us the correct hourly wage for tipped employees of $ 4.19 so I know he is shady.

Absolutely Not!
I would say report him, but I do know you need your job. But no he can’t do that!*Report to the better business bureau… google it, you can submit it online.

Let me ask you this. Do you report 100% of your tips as income, for tax purposes?
If you aren’t reporting 100% of your tips for tax purposes….take your 2% hit and STFU.

so why would any other part of your employment with this dude be legal?

id be looking elsewhere and when i leave i would definately be reporting him!
you might even get some backpay(doubt it though)

Doesn’t sound right. Here is a link to The US dept of Labor Offices in Florida. Contact them and they can help you out. You may be entitled to back wages if he is found in violation of labor law. Also, you probably can report him anonomously so you don’t have to wait until you leave.
